Terms of Service

These Terms of Service (“Terms”) govern your use of ClaimNarrative (“Service”), operated by Sunil Kaimootil as a sole proprietorship doing business as ClaimNarrative, with a business address at 3325 Piedmont Rd NE Unit 2507, Atlanta, GA 30305 (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
ClaimNarrative provides software that uses artificial intelligence to draft claim documentation, including narratives, coverage analyses, reserve justifications, closure summaries, Request for Information (RFI) responses, and file analysis (Xactimate PDF parsing, photo analysis, document text extraction), for licensed insurance adjusters working with commercial property claims.
The Service is a drafting assistant. It does NOT:
- Provide legal advice
- Provide adjusting services
- Make coverage determinations
- Substitute for the professional judgment of a licensed adjuster
- Guarantee accuracy of generated output
All output requires human review by a licensed adjuster before submission to carriers or other parties.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts to use the Service. By using the Service, you represent that you meet these requirements.
The Service is intended for use by licensed independent insurance adjusters and adjuster firms. By using the Service, you represent that you hold any required licensing to perform adjuster work in your jurisdiction.
3. Account Registration
You must create an account to use most features. You agree to:
- Provide accurate, current information
- Maintain the security of your password
- Notify us immediately of unauthorized access
- Accept responsibility for all activity on your account
We may suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Upload claim information for clients without authority to do so
- Attempt to reverse engineer, decompile, or extract the underlying AI models or prompts
- Resell, sublicense, or redistribute the Service without written authorization
- Use the Service to generate content for fraudulent claims
- Submit AI-generated output to carriers, insureds, or other parties without thorough human review and verification of all facts, citations, dollar amounts, and conclusions
- Use the Service to harass, defame, or harm any party
- Attempt to overload, disable, or compromise the Service
- Use automated tools to scrape or copy the Service
5. Intellectual Property
5.1 Our IP
The Service, including software, prompts, design, and content, is owned by ClaimNarrative and protected by U.S. and international intellectual property laws.
5.2 Your Content
You retain ownership of content you submit (claim file information, field notes, etc.). You grant us a limited, non-exclusive license to use this content solely to provide the Service to you.
5.3 Output
You own the AI-generated output produced through your use of the Service. You may use, edit, and submit this output as part of your professional adjuster work.
6. Pricing and Payment
6.1 Implementation Fee
The current implementation fee is $1,500 USD, payable upon signing a service agreement. This fee covers initial setup, custom configuration, training, and onboarding.
6.2 Subscription Fee
Following implementation, the monthly subscription fee is $300 USD, billed monthly in advance, beginning 30 days after delivery.
6.3 30-Day Money-Back Guarantee
If, within 30 days of delivery, you determine the Service is not saving you significant time on claim documentation, you may request a full refund of the implementation fee and cancel the subscription. Refund requests must be submitted in writing to support@claimnarrative.com within the 30-day window.
After the 30-day window:
- Implementation fees are non-refundable
- Monthly subscriptions can be cancelled with 30 days written notice
- No prorated refunds for partial months
6.4 Payment Methods
Payments are processed via Stripe or wire transfer. Failed payments may result in suspension of the Service.
7. Termination
7.1 By You
You may terminate your account at any time by emailing support@claimnarrative.com. Refer to Section 6.3 for refund eligibility.
7.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Non-payment
- Suspected fraud or abuse
- Legal requirements
We will provide reasonable notice when possible.
7.3 Effect of Termination
Upon termination:
- Your access to the Service ends
- Your data may be deleted after 30 days
- Sections of these Terms that by nature should survive (including IP, disclaimers, limitations of liability) will survive termination
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING:
- We do not warrant that AI-generated output is accurate, complete, or suitable for any particular purpose
- We do not warrant that the Service will be uninterrupted or error-free
- We do not warrant compliance with any specific carrier requirements or industry standards
- The adjuster using the Service remains solely responsible for the accuracy and appropriateness of all submitted work product
REFERENCE FILE LEARNING:
The Service extracts stylistic patterns from your uploaded reference files. We do not warrant that pattern extraction is complete, accurate, or that learned patterns will be applied consistently. Output remains AI-generated and subject to all disclaimers in this section.
FILE UPLOAD PROCESSING:
When you upload Xactimate PDFs, field notes, or photos, the Service uses AI to extract or analyze content. We do not warrant accuracy of extracted data, dollar amounts, or photo descriptions. All extracted content requires verification.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability for any claim arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim
- We are not liable for indirect, incidental, consequential, special, or punitive damages
- We are not liable for lost profits, lost revenue, lost data, or business interruption
- These limitations apply regardless of the legal theory (contract, tort, statute, etc.) and even if we have been advised of the possibility of such damages
10. Indemnification
You agree to indemnify and hold harmless ClaimNarrative, its operator, and its agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your submission of AI-generated output to carriers, courts, or other parties
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through:
- Good faith negotiation between the parties
- If negotiation fails, binding arbitration in Atlanta, Georgia under the rules of the American Arbitration Association
You waive any right to participate in class action lawsuits or class-wide arbitration.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance.
13. Miscellaneous
- Entire Agreement: These Terms (and any service agreement you sign) constitute the entire agreement between you and us regarding the Service
- Severability: If any provision is unenforceable, the rest remains in effect
- No Waiver: Failure to enforce any provision does not waive future enforcement
- Assignment: You may not assign these Terms; we may assign them in connection with a business transfer
